India has observed a series of disturbing press freedom attacks in 2023, including the commencement of the terrorism trial of detained Kashmiri journalist Fahad Shah, as well as the raids on the BBC offices in Delhi and Mumbai following an Indian government order censoring the broadcaster’s critical documentary on Modi.

Today, FINALLY, Craig is going to talk about Free Speech! Now, free speech is so important because it not only allows you to critique the government, but it also protects you from the government. But it's essential to remember that not ALL speech is protected equally under the First Amendment, and just because you have a right to free speech doesn't mean your employer, for instance, can't fire you for something you say (unless your work for the government and then things get a bit more complicated). So we'll take a look at a couple significant Supreme Court cases that have gotten us to our current definition of free speech, and we'll also discuss some of the more controversial aspects of free speech - like hate speech.

Geeta Seshu is a founding editor of the Free Speech Collective, an organization formed in 2018 to promote the rights to freedom of expression and dissent in India. An independent journalist and media analyst, she has reported on issues including media ethics and ownership, regulation of news television, digital access and online harassment of women, and privacy. She is a member of UNESCO’s Media Freedom Committee in India and previously served as a consulting editor for the media watchdog site The Hoot.
Anuradha Bhasin is a journalist and peace activist who has extensively reported on politics, conflict, and human rights in Jammu and Kashmir. She is executive editor of the Kashmir Times, the oldest English daily in the region, and her writings have appeared in various Indian and international publications, including the New York Times. She is currently a John S. Knight Journalism Fellow at Stanford University.
Shahina K.K. is a senior editor for Outlook magazine and one of the first Indian journalists to be charged under the Unlawful Activities (Prevention) Act, India’s draconian anti-terror law. She faces ongoing judicial harassment in a case opened nearly 13 years ago by the then BJP-led government in Karnataka state following her investigative report claiming that police had fabricated witness statements to arrest a suspect in connection with the 2008 bomb blasts in Bangalore.
